New Buyers:
* A Buyer is:
-the highest bidder on an item in a Reserve Style Auction, and that bid passes the Seller's reserve, OR -the highest bidder in a Basic Style Auction, OR -a winning bidder in a Dutch Style Auction, OR -the bidder where the bidder and Seller agree to a price in a Haggle TM , OR -the bidder who successfully uses the Buy-it-Now feature.
* All bids placed on Auctions or orders placed for a item in a Storefront Ad are binding on the buyer, are final and may not retracted. JFK Auction.com will not retract a bid placed on an auction unless we determine the seller is a fraud or the bidder is a fraud and is attempting to disrupt or interfere with a Seller's valid Auctions or Ads. * A Buyer is contractually obligated by this Agreement to complete the transaction. * The Buyer is obligated to respond to a Seller within 2 business days of that Seller's attempt to contact the winning Buyer in an auction or Ad, or that Buyer's right to purchase the item(s) is forfeit. Failure to respond by a Buyer can result in Negative feedback. A Buyer may affirmatively discharge this duty by contacting the Seller through the Auction or Ad message link to the Seller, and thereafter responding to any contact from the Seller either through phone, email or JFK Auction.com message. * The Buyer must send payment by traceable means within 2 business day of contact from the Seller providing specific Payment instructions.
* Bidders: We do not accept payment in any form for any item(s) that you bid on. You must remit payment directly to the seller for any item you bid on or win. If you pay us for an item you won we reserve the right to deduct any fees or costs we incur as a result of receiving your payment or refunding your money, including check fees and/or credit card transaction fees.**
* If the Buyer isn't contacted by the Seller within 3 business days after the day the auction closes, the Buy-it-Now is exercised, or an order is placed through a Storefront Ad, the Buyer is relieved of any obligation to purchase that item. The Seller may then relist the item. * If the Buyer properly notifies the Seller of a return under the 3-Day Inspection Policy, the Buyer must take all prudent and reasonable steps to protect, return and insure the Seller's property. This includes properly packaging the Items against harm in shipping and insuring the Item for the value of the underlying auction price. * Damage in Shipment: A Buyer must timely report any apparent or potential damage in shipping to the Seller and within 3 business days of receipt of any item. The Buyer will initiate a report to the Seller and to the carrier of such suspected damage in shipping, initiate any required insurance reports if the item is insured and cooperate with any insurance investigations and adjusters. All packaging, boxes and labels must be retained by the Buyer for the potential use in an insurance claim by adjusters. Failure to retain packing materials for insurance investigations, or to cooperate with an insurance investigation may result in the Buyer losing rights under the 3 Day Inspection Period and having the transaction considered final with the Buyer as owner of the item. In such case insurance proceeds, if any, received by the Seller shall be promptly sent to the Buyer. * Any User whose first and only feedback is negative will be immediately disabled. If a Buyer receives two (2) negative feedbacks in two (2) different auctions in a period of less than three (3) months OR three (3) negative feedbacks in three different auctions total as the result of a failure to complete the purchase of an item where that Buyer is the winner of the item, that Buyer's account will be disabled indefinitely.
All of our auctions use something known as the '15 minute rule'.
In a typical auction setting, there is always a called out counting
that happens to allow buyers time to decide to place higher bids. This
'final call' is reset each time someone places a bid. "Going Once,
Going Twice, Going Three times" - someone places a bid - "Going Once,
Going twice" - another bid placed - "Going once, going twice".. and on
and on until the auctioneer completes the entire phrase "Going Once,
Going Twice, Going Three times, SOLD to the highest bidder"
So this rule is no different, but because of delay caused by the
internet and other possible technological speed bumps, we have a 15
minute final call time.
When the seller lists an item, he specifies the number of days the auction will run. The auction listings display the scheduled
closing time for the auction. If there is bidding activity on the
auction within fifteen (15) minutes of when the auction is scheduled to
close, the auction automatically switches into a special mode analogous
to the 'going, going, gone' period of a live auction. In this mode, the
auction is automatically extended until there have been no bids placed
within fifteen (15) minutes. When fifteen (15) minutes have passed with
no bidding activity, the auction closes. The 15 minute rule makes auctions unbiased, by allowing all bidders an
equal opportunity to place their best bid. In other online auctions
where an auction ends exactly at a given time, some bidders will hold
their bids until the last minute or so, in the hope of winning an item
on the cheap. This is referred to as 'sniping'. The 15 minute rule
gives all bidders an equal opportunity to place their best bid on an
item before the item closes. This way, no bidder loses an item to
sniping, and the seller can be assured that he has gotten maximum value
for the item.

Terms of Sale. Unless otherwise stated in the seller's Auction
Description, the terms of sale of an auction item are as follows:- Buyer pre-pays in US funds by personal or business check, bank check, money order, or Escrow.
- Personal or business checks will be held until they clear (7 business days).
- Buyer pays estimated/actual cost of shipping and insurance.
- Payment must be received within 10 days of initial contact by seller
- Item is guaranteed to be working and as described when delivered; no other warranty
(express or implied) is offered by seller.
- Other items such as knives may require proof of age before they can be
shipped.
The seller can hold personal checks or money orders until payment clears for a maximum
of seven (7) business days. Items must be shipped promptly upon clearance of funds. In
general, no transaction should take over 30 days from the close of auction until the buyer
receives the item. Seller (or seller's common carrier) is responsible for the item until
the item is received by the buyer or the buyer's transfer dealer. We strongly recommend
insuring all shipments and using delivery confirmation wherever possible. When listing an item, you can add additional features to enhance
your listing. You can also choose to place your items in our Featured
or Category sections for more exposure. Category auctions are featured
on the Gun-Seller.com home page. Featured auctions are listed above
normal listings at the top of the page in each auction category. Icons,
boldface titles, and colored titles catch the buyer's eye, driving more
bidders to your auction.
Many bidders will not even look at an auction listing if it does not
contain a picture. Adding a picture to your listing lets the bidder see
what he or she is bidding on. SELLERS:

There will be two types of fees that may be incurred when you list or sell items on JFK Auction.com. We will charge a Final Value Fee that is assessed only if your item ends with a winning bidder. We offer some Optional Services that can be used to enhance the listing that must be paid for whether or not the item is sold. If you choose to use any of our Optional Services and the item does not sell it can be relisted free of charge using the same options. For any item that is won by one bidder we assess a final value fee based on the selling price of the item. A sold item is one that is bid on and won by a bidder in accordance with our User Agreement. If an item does not sell, no Final Value Fee is assessed. In other words, if you create a basic listing (one that uses no Optional Services) and the item does not sell you owe us nothing.

In order to sell on the JFK Auction.com, Seller's must first become verified. There is a one time fee of $5.00, and verification will remain as long as the contact info remains the same. When listing an item, you will be prompted to verify your account before proceeding. Once verification is completed, you will not receive this prompt again.
* JFK Auction.com is an online marketplace where items buyers, sellers, merchants and aficionados meet to conduct transactions. We are not involved in the actual transactions between Buyers and Sellers.

* JFK Auction.com takes no responsibility for the truth or accuracy of auction listings, or the quality, safety, or legality of any items offered at auction. * JFK Auction.com reserves the right to modify this agreement at any time, without prior notification. * When you register as an JFK Auction.com User ("User"), you are registering as a Bidder with the option of becoming an JFK Auction.com Seller and/or Storefront Merchant later.
*Registration. Members agree to provide true and accurate information about him/herself in the registration form.
It is a violation of Federal law to make bids in a false name or with an invalid credit card, even if our software initially accepts such a bid. Please be aware that even if you do not give us your real name your web browser transmits a unique Internet address to us which can be used by law enforcement officials to identify you. Do not test our auctions with false bids. This puts you at substantial personal legal risk. Fraudulent bidders will be prosecuted to the fullest extent of the law. Currently, both the FBI and the US Secret Service are responsible for investigating Internet fraud cases.

*Listing. Placing an item for auction is an irrevocable offer to sell an item to the winning bidder. The winning bidder is the highest bidder on the item, or in the event of a tie, the bidder who placed the highest bid chronologically earliest. In the case of a reserve price auction a bid is only a winning bid if it meets or exceeds the reserve price on the item. In the case of a Dutch auction there may be more than one winning bid depending on the quantity of items available and the number of bids placed.
Listing an item constitutes entering a binding legal agreement to sell the item to the highest bidder as determined by the rules of the auction. Items listed on this auction site may not be concurrently offered for sale on any other online auction site. Once an item is listed and has received a winning bid, the item may not be withdrawn from sale. Please consider carefully whether you want to place an item for auction.
When listing items, ensure that the items listed for auction do not infringe upon the copyright, trademark or other rights of those third parties. By listing items for sale on this site you represent to us that your items do not infringe on the intellectual property of any third party and that you have a legal right to sell the items you list. Your description of the item must be truthful and accurate. The sale of your item(s) on this auction site: (a) shall not be fraudulent or involve the sale of counterfeit or stolen items; (b) shall not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (c) shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (d) shall not be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (e) shall not be obscene or contain child pornography; and (f) shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. You may not post on our site or sell through our site any: (a) item that, by paying to us the listing fee or the final value fee, could cause us to violate any applicable law, statute, ordinance or regulation, or (b) live animals, human beings or body parts (relics, skulls, human remains or other parts), bulk email lists, illegal weapons, instructions/kits/plans/parts designed to illegally convert items to full-auto fire, instructions/kits/plans/parts designed to illegally build silencers, or instructions on how to build bombs or explosives.
In the event of a conflict, the rules of the auction as specified by this document supercede the terms stated in the seller's auction listing. A seller may not alter the rules of the auction by the language of his listing.
By listing an item, you authorize us to release your contact information, including name, address, email, and telephone number, to the bidders who place bids on this item. *Listing Content / Multiple Listings. Auction listings must offer a specific product or service at a specific price. Any listing deemed to be general advertising instead of an offering of something specific for sale will be removed. We reserve the right to edit or remove auction listings as deemed necessary by the auction site. Listings may be moved to a different category if deemed inappropriate for the listed category, so put your listing in the most appropriate category. We reserve the right to remove any listing deemed inappropriate or in violation of the letter or spirit of our rules.
We do not allow the posting of excessive numbers of listings for the same item. Excessive duplicate listings will be removed without notice.

Buyers and sellers involved in a 'side deal' cannot post feedback and cannot use the auction site's problem resolution tools. We provide absolutely no assistance of any kind for buyers and sellers involved in a 'side deal' in any way in the event of problems.
If a bid does not meet or exceed the reserve price (if any) on the item, then the bid is not a winning bid and the non-winning bidder is not obligated to buy the item. Sellers are prohibited from soliciting side deals with non-winning bidders during or after the auction. Non-winning bidders are prohibited from contacting sellers and requesting a side deal during or after the auction. Soliciting side deals may result in suspension or or termination of your account. *Auction Closing. The auction listings display the scheduled closing time for the auction. If there is bidding activity on the auction within fifteen (15) minutes of when the auction is scheduled to close, the auction automatically switches into a special mode analogous to the 'going, going, gone' period of a live auction. In this mode, the auction is automatically extended until there have been no bids placed within fifteen (15) minutes. When fifteen (15) minutes have passed with no bidding activity, the auction closes. *Bid Manipulation. Bid manipulation of any kind is expressly forbidden. A seller is prohibited from placing bids or arranging to have bids placed on behalf of seller, seller's agent or assigns. No shill bidding is allowed. Buyers are prohibited from communicating with each other with the purpose of manipulating the final purchase price of an item *User-Generated Content. This auction site is not responsible for the content of user-generated content including auction listings, messages on our message forums, feedback, pictures, etc. For legal reasons we do not screen user-generated content.
You are solely responsible for any information you post our use on this site, and we act as a passive conduit for your online distribution and publication of this information. If you post information that is slanderous, violates any international, federal, state, or local law, or violates the intellectual property of another party you will be solely liable for the consequences. We may take any action with respect to such information we deem necessary or appropriate in our sole discretion if we believe it may create liability for us or may cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
Complaints of copyright violations or infringement of any other type of intellectual property are covered in this document under the section labeled Intellectual Property.
*Technical Difficulties. This auction site is not responsible for bids not being processed or not being accepted due to technical difficulties. Auctions will not be extended due to technical problems. Do not wait until the last minute to bid! * JFK Auction.com is available only to individuals who can form legally binding contracts under applicable law. Our services are not available to minors. JFK Auction.com restricts the ability of Users to place bids or order from Storefront Ads based on their geographic location - International users (those JFK Auction.com Users not resident in the 50 United States of America) are not permitted to bid on Auctions in Firearms or Ammunition categories or Purchase items in Firearms or Ammunition categories from Storefront Ads. If you reside outside the 50 United States, please refrain from using JFK Auction.com for items or ammunition sales. (If Applicable)!
* Every User is required to maintain a valid email address and phone number with JFK Auction.com. This phone number and email address will be provided to the other party involved in any Buyer/Seller transaction in order to facilitate the transaction. Failure on the part of any User to maintain a current and valid phone number and email address on file may result in that User's account being disabled. Additionally, failure on the part of a Seller to maintain a current and valid phone number and/or email address at JFK Auction.com may also result in that Seller's current auctions being removed. Should this occur, Buyers under that Seller's closed auctions are released from their obligation to complete a sale should they so choose. A Seller, however, is not released from Seller's obligation to sell. All Users agree to remove/adjust all email SPAM filters which may interfere with properly receiving email from any auctionarms.com host email address or from the other party in a Buyer/Seller transaction. Interruption of email communications from JFK Auction.com host addresses by SPAM filters may result in the User's account being disabled. * Users are explicitly prohibited from advertising for other Auction Websites or other sales venues in any one of the available methods of posting information at JFK Auction.com. JFK Auction.com reserves the right to make that distinction. * Users are explicitly prohibited from using any form of extraction method or other technology for retrieving email addresses from JFK Auction.com for the purposes of SPAMMING or advertising of any kind. JFK Auction.com reserves the right to make that distinction. * JFK Auction.com reserves the right to refuse service to anyone at anytime. * Users release JFK Auction.com of any liability resulting from the use or misuse of any item advertised for auction or sale, bid on or sold at JFK Auction.com. * Users agree to hold JFK Auction.com harmless if a loss or damage is experienced through the use of this system. * JFK Auction.com does not guarantee that any Seller will complete the sale of an item or any Buyer will complete the purchase of any item. * Any legal disputes arising from the use of JFK Auction.com falls under the law and jurisdiction of the State of Arkansas without regards to the Choice of Law laws of that jurisdiction. * JFK Auction.com does not assume any responsibility for any inappropriate use of the system, for any false demographic information, or for JFK Auction.com Users sending unsolicited commercial or non-commercial email to other users. * JFK Auction.com is not responsible for damage or loss caused by errors in the system or by interruption of Internet traffic. As a JFK Auction.com User, you use JFK Auction.com at your own risk. * 3 Day Inspection Period: When a Seller sells a item, the Seller (at his/her discretion) is required to give the Buyer a minimum of three business days after the day of receipt of the Buyer's Funds , to inspect that item. If during the 3 Day Inspection Period, the Buyer decides to decline the sale, it is the Buyer's responsibility to first contact the Seller by telephone to notify the Seller of Buyer's decision to return the item, and to pay for return shipping, insurance and any other fees related to the return of that item back to the Seller. The Buyer may return a item to a Seller for a full refund (as long as the Seller has been notified of the Buyer's decision to return the item) for any reason. Once the Seller has been properly notified Seller will provide buyer with return instructions, Buyer will return the item fully insured for the auction price, adult signature required to the Seller within 3 business days of receipt of return instructions and provide the Seller with a valid shipping tracking number. Seller is obligated to issue a full refund for the item minus only the Buyer's original shipping, handling and insurance fees. Seller's may not withhold from the refund any "re-stocking", inventory, or added handling fees. At no time during the 3 Day Inspection Period will the Buyer dissasemble the item (unless otherwise agreed to in writing by the Buyer and Seller prior to the sale). If the Buyer dissasembles the item at any time during the 3 Day Inspection Period without the Seller's prior express written consent, the sale is considered final Inspection consists of external examination for any damage. In the event the Buyer has properly declined the sale and notified the Seller, the Seller will only issue a refund AFTER the item in question has been returned to the Seller. Seller will issue the refund within 2 business days after return receipt of the item and will provide Buyer with either a tracking number, if the refund is sent by common carrier or the US Postal Service, or a transaction authorization number if the refund is in the nature of a Credit to the Buyers Credit Card. The Buyer is only responsible for his original charges for shipping, handling and insurance and return costs. If a Buyer elects to return a item during the 3 Day Inspection Period, the Buyer will receive a neutral feedback in order for the Seller to recover his Final Value Fees. * If a Buyer, after unsuccessful attempts to contact the Seller by telephone on at least 2 separate occasions, can not notify the Seller within the required time of his decision to return a item under the 3 Day Inspection Period, the Buyer may preserve his right to return the item by sending an email notification to the Seller. The email notification should state 1) the auction number, 2) the Buyer's desire for Seller's instructions to return the item under the 3 Day Inspection Period, 3) the dates and times he attempted to contact the Seller by telephone, 4) the number(s) called and, 5) the results of each call (no answer, left message, phone not in service,etc.). This email should be sent directly to the Seller with a copy to support@gun-seller.com. This email will provide adequate proof of Buyer's timely notification of the Seller within the 3 Day Inspection Period. The Seller must either respond within 3 business days with return instructions by email (with a copy to support@gun-seller.com) or by telephone. If the Seller fails to provide return instructions within 3 business days of the email notification, The Buyer should file a negative feedback on the Sale and notify JFK Auction.com for further instruction and support. Under no circumstances should a Buyer return a item without receiving specific return instructions from the Seller. * Other Items Inspection Period: The mandatory 3 Day Inspection Period only applies to items as defined by the BATF (including antique items). All other returns for any other type of item will be either as stated in the auction and at the discretion of the Seller, or as may otherwise be agreed to in writing by the Buyer and Seller. * For the purposes of these Terms and Conditions, a business day is a Monday through Friday 9am to 5pm, not including United States National Holidays. * All JFK Auction.com Users are expected to abide by all federal, state, and local laws ("Law") governing the offering, transfer, ownership and sale of items, ammunition and other items. It is the obligation of the JFK Auction.com User to know and to abide by the Law applicable to such user regarding such transactions. It is critical that users of JFK Auction.com use our service in a legal manner, and consistent with standards of good citizenship. If, in the sole determination of JFK Auction.com, any User is considered to be in violation of or has violated any applicable Federal State or Local laws in the use of our system that User will be immediately expelled, and the proper authorities notified. JFK Auction.com will cooperate with law enforcement in the prosecution of any individual suspected of breaking violating items law. * JFK Auction.com may edit or remove any auction it, in its sole and final discretion finds illegal, in violation of these terms and conditions, inappropriate, offensive, misleading, fraudulent, in poor taste or for any other reason. * All Users are expected to conduct themselves in their dealings with other JFK Auction.com Users in a professional, polite, courteous and business like manner. Any User who willfully threatens, abuses, intimidates, bullies, harasses, or in any way interferes with another User's Auctions or peaceful enjoyment of JFK Auction.com services or who uses profane, vulgar, coarse, threatening or offensive language in their dealings here may, in the sole and final discretion of JFK Auction.com, have their membership immediately terminated without warning.
*System Abuse. This auction site reserves the right to refuse service to anyone. We will exercise this right with "problem" buyers who win an auction and fail to complete the transaction, and with "problem" sellers who list an item and fail to sell it to the high bidder(s). Without limiting any other remedies, this auction site may terminate your account if you are found (by conviction, settlement, insurance or escrow investigation, or otherwise) to have engaged in fraudulent activity in connection with our site. You agree to be liable for and to pay for any costs incurred by this site for your misuse of the site or for your violation of any of the site's rules, including but not limited to Final Value Fees incurred for any items you win but fail to pay for, Final Value Fees for any items on which you place bogus bids, and the cost of our time spent in resolving deliberate rules violations. * JFK Auction.com may terminate your membership and any of your current auctions or bids immediately if you breach this Agreement or if JFK Auction.com is unable to verify or authenticate any information you provide to us. We encourage all users to leave feedback about your trading
partners. Only individuals directly involved in the transaction will be
able to submit feedback about that transaction. Feedback is submitted
in the form of a letter grade (A+, A, B, C, D, F, A+ being the best)
and a brief narrative of the transaction. A composite feedback grade is
determined by calculating the average of all feedback entered for a
given user. This composite grade is displayed next to the user's name
on the site.
Feedback is a useful tool for helping to evaluate the
trustworthiness of a buyer or seller. However, feedback is not a
substitute for checking out a seller or buyer yourself. Caveat Emptor

The feedback system only works if it is used as intended. Please
take the time to leave feedback (favorable or unfavorable) on all
transactions. Before leaving unfavorable feedback for a user, try to
contact the user and work the problem out. The feedback system is not
intended as a way to wage a personal vendetta against a user. Do not
abuse the privilege of posting feedback about others. Improper use of
the feedback system may result in the permanent revocation of user
privileges.
At the completion of your transaction, you should post feedback on
the seller. Feedback lets other users know how the seller handled his
transaction with you.
When posting feedback, please be honest and unemotional about the
transaction. Posting 'the seller is a jerk' is not very helpful or
informative. Posting 'the seller contacted me promptly but took three
weeks to ship the item' is informative and truthful. The seller gets
the chance to reply to your feedback, and you can post a follow-up to
his response. |
